SC issues notice Jhk's petition challenging the quashing of FIR against BJP MPs in Deoghar airport case

The Supreme Court on Monday issued a notice in a petition filed by the state of Jharkhand challenging.

Jharkhand High Court order quashing FIR against BJP MPs Nishikant Dubey, Manoj Tiwari and several others in Deoghar airport case.

The FIR was lodged over allegations that the accused had threatened and forced the ATC to allow private jets to take off in violation of security regulations at Deoghar airport in September 2022, Live Law reports.

A bench comprising Justices Abhay S. Oka and Sanjay Karol issued notices to Dubey, Tiwari and other accused in the state's case. The High Court held that IPC offenses are not attracted as there is a separate law viz.

Aircraft Act, 1934 (Act). It was further held that the FIR was not maintainable as only a complaint can be filed with the DGCA under Section 12B of the Act.
